<\/p>\n\n\n\n

The delegates are volunteers appointed by the Defender of Rights and hold local office hours throughout the country.<\/p>\n\n\n\n

Overview<\/strong><\/h2>\n\n\n\n

The Defender of Rights Delegate<\/strong> is a local representative of the Defender of Rights. Their mission is to welcome, inform, and assist free of charge any person who considers that their rights have not been respected by an administration, a public service, or in certain other situations provided for by law.<\/p>\n\n\n\n

The delegate acts independently, impartially, and confidentially. They favor dialogue and the search for an amicable solution prior to any contentious proceedings. When the case requires it, they may forward it to the services of the Defender of Rights so that it can be the subject of a thorough investigation.<\/p>\n\n\n\n

Their assistance is entirely free of charge.<\/p>\n\n\n\n

Types of disputes handled<\/strong><\/h1>\n\n\n\n

The Delegate may intervene in particular in the following situations:<\/p>\n\n\n\n

Relations with government authorities and public services<\/strong><\/h3>\n\n\n\n

  • City hall, prefecture, sub-prefecture.<\/li>\n\n\n\n
  • CAF, CPAM, MSA.<\/li>\n\n\n\n
  • France Travail.<\/li>\n\n\n\n
  • National Education.<\/li>\n\n\n\n
  • Local authorities.<\/li>\n\n\n\n
  • Public hospitals.<\/li>\n\n\n\n
  • Tax services.<\/li>\n\n\n\n
  • Various public agencies.<\/li>\n<\/ul>\n\n\n\n

    Discrimination<\/strong><\/h3>\n\n\n\n

    Any discrimination based in particular on:<\/p>\n\n\n\n

    • The origin; ;<\/li>\n\n\n\n
    • sex ;<\/li>\n\n\n\n
    • the disability ;<\/li>\n\n\n\n
    • the state of health ;<\/li>\n\n\n\n
    • age ;<\/li>\n\n\n\n
    • religious beliefs ;<\/li>\n\n\n\n
    • the opinions ;<\/li>\n\n\n\n
    • sexual orientation ;<\/li>\n\n\n\n
    • the family situation ;<\/li>\n\n\n\n
    • trade union activity ;<\/li>\n\n\n\n
    • or any other criterion prohibited by law.<\/li>\n<\/ul>\n\n\n\n

      Children's rights<\/strong><\/h3>\n\n\n\n

      The Defender of Rights also ensures the respect of the rights of minors.<\/p>\n\n\n\n

      Code of ethics of the security forces<\/strong><\/h3>\n\n\n\n

      The Defender of Rights can be contacted regarding the behavior of:<\/p>\n\n\n\n

      • of the National Police ;<\/li>\n\n\n\n
      • of the National Gendarmerie; ;<\/li>\n\n\n\n
      • from the municipal police; ;<\/li>\n\n\n\n
      • correctional officers ;<\/li>\n\n\n\n
      • security guards performing a public service mission.<\/li>\n<\/ul>\n\n\n\n

        Situations outside their remit<\/strong><\/h1>\n\n\n\n

        The Delegate generally cannot intervene:<\/p>\n\n\n\n

          \n
        • in a commercial dispute between a consumer and a professional (falling notably under consumer mediation); ;<\/li>\n\n\n\n
        • in a purely private dispute between individuals; ;<\/li>\n\n\n\n
        • in a dispute between two companies; ;<\/li>\n\n\n\n
        • to modify or overturn a court decision; ;<\/li>\n\n\n\n
        • to replace a lawyer; ;<\/li>\n\n\n\n
        • to replace the judge; ;<\/li>\n\n\n\n
        • when the request is clearly unrelated to the duties of the Defender of Rights.<\/li>\n<\/ul>\n\n\n\n

          How they can help<\/strong><\/h1>\n\n\n\n

          Depending on the available office hours, the representative can receive people:<\/p>\n\n\n\n

            \n
          • in person ;<\/li>\n\n\n\n
          • by phone ;<\/li>\n\n\n\n
          • by mail ;<\/li>\n\n\n\n
          • by email ;<\/li>\n\n\n\n
          • sometimes during video conferences.<\/li>\n<\/ul>\n\n\n\n

            The consultation hours are organized notably in prefectures, sub-prefectures, town halls, Justice Access Points (Points-Justice), France Services centers, or other public reception venues.<\/p>\n\n\n\n

            Eligibility requirements<\/strong><\/h1>\n\n\n\n

            For the application to be reviewed:<\/p>\n\n\n\n

              \n
            • it must fall within the remit of the Defender of Rights; ;<\/li>\n\n\n\n
            • the facts must be sufficiently precise; ;<\/li>\n\n\n\n
            • supporting documents must be available; ;<\/li>\n\n\n\n
            • The applicant must be directly affected or legally represent the data subject.<\/li>\n<\/ul>\n\n\n\n

              In disputes with a government agency, it is recommended to have first made an inquiry or request to it.<\/p>\n\n\n\n

                4. Clearly state the facts and the steps already taken.<\/li>\n\n\n\n

                6. The delegate is analyzing the file.<\/li>\n\n\n\n
                7. If necessary, he requests additional documents.<\/li>\n\n\n\n
                8. He seeks an amicable solution when it is possible.<\/li>\n\n\n\n
