This procedure requires the intervention of a judicial commissioner and may also require the assistance of a lawyer, depending on the nature of the case and the amount in dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before taking any steps, <a href=\"https:\/\/lannuaire.service-public.gouv.fr\/?utm_source=chatgpt.com\" data-type=\"link\" data-id=\"https:\/\/lannuaire.service-public.gouv.fr\/?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener\">Alice identifies the local court <\/a>competent<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>in general, the local court ;<\/li>\n\n\n\n<li>for a consumer dispute, she can often bring the matter before the court of her place of residence, otherwise, the court of the defendant's place of residence generally has jurisdiction,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Alice gathers all the useful parts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>contract, quote or invoice; ;<\/li>\n\n\n\n<li>email exchanges ;<\/li>\n\n\n\n<li>certified mail ;<\/li>\n\n\n\n<li>formal notice ;<\/li>\n\n\n\n<li>photographs ;<\/li>\n\n\n\n<li>potential certificates ;<\/li>\n\n\n\n<li>any document establishing the facts.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">She sorts the parts and assigns them a number:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Document No. 1: invoice ;<\/li>\n\n\n\n<li>Exhibit No. 2: formal notice; ;<\/li>\n\n\n\n<li>Exhibit No. 3: acknowledgment of receipt ;<\/li>\n\n\n\n<li>etc.<\/li>\n\n\n\n<li><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Alice is drafting a draft request using <a href=\"https:\/\/votre-litige.fr\/en\/page-de-test\/\" data-type=\"page\" data-id=\"1267\">the appropriate Cerfa form<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Her request contains in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>her full name and contact details;<\/li>\n\n\n\n<li>the identity of Bob ;<\/li>\n\n\n\n<li>the contact details of the parties; ;<\/li>\n\n\n\n<li>the chronological presentation of the facts ;<\/li>\n\n\n\n<li>the amicable steps already taken; ;<\/li>\n\n\n\n<li>the amounts claimed or the requested solution; ;<\/li>\n\n\n\n<li>the list of attachments<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Alice goes to the court registry and the registry clerk:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>verify that the file is complete; ;<\/li>\n\n\n\n<li>save the request; ;<\/li>\n\n\n\n<li>assign a file number; ;<\/li>\n\n\n\n<li>Issue a receipt if necessary.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The registry does not judge the case.
