Unlike a judge or an arbitrator, they do not settle the dispute and do not impose any decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mediator may practice independently, within an office, an association, or a company. Some mediators are registered on a list drawn up by a court of appeal, after the opinion of the general assembly of magistrates. This registration constitutes a guarantee of competence recognized by the courts but is not mandatory to practice conventional mediation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mediation is based on confidentiality, voluntarism, and the search for a balanced agreement.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Types of disputes handled<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The private mediator can intervene, in particular, in the following disputes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>disputes between individuals ;<\/li>\n\n\n\n<li>family disputes (excluding regulated family mediation when a specialized service is required); ;<\/li>\n\n\n\n<li>neighborhood disputes; ;<\/li>\n\n\n\n<li>disputes between partners or shareholders; ;<\/li>\n\n\n\n<li>disputes between companies; ;<\/li>\n\n\n\n<li>commercial disputes; ;<\/li>\n\n\n\n<li>disputes between employers and employees (excluding specific proceedings); ;<\/li>\n\n\n\n<li>real estate or condominium disputes; ;<\/li>\n\n\n\n<li>contract disputes; ;<\/li>\n\n\n\n<li>disputes related to the provision of services; ;<\/li>\n\n\n\n<li>disagreements between professionals and clients when no mandatory industry mediator has jurisdiction.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Situations outside their remit<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Private mediation is generally not suitable when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An urgent court order is necessary; ;<\/li>\n\n\n\n<li>a criminal offense must be prosecuted; ;<\/li>\n\n\n\n<li>one of the parties refuses all discussion; ;<\/li>\n\n\n\n<li>one of the parties is deprived of legal capacity without appropriate representation; ;<\/li>\n\n\n\n<li>The dispute must be referred to a specialized body (consumer ombudsman, banking ombudsman, insurance ombudsman, etc.); ;<\/li>\n\n\n\n<li>Public policy prohibits any such transaction.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>How they can help<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the needs of the parties, the mediator may intervene:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>in person ;<\/li>\n\n\n\n<li>by phone ;<\/li>\n\n\n\n<li>via videoconference ;<\/li>\n\n\n\n<li>by email exchange; ;<\/li>\n\n\n\n<li>in a hybrid format (in-person and remote).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Some mediation sessions include joint meetings and, if necessary, separate meetings (caucuses).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Eligibility requirements<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Mediation generally involves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the voluntary agreement of all parties; ;<\/li>\n\n\n\n<li>a specific dispute; ;<\/li>\n\n\n\n<li>identified parts; ;<\/li>\n\n\n\n<li>the absence of any procedure that is incompatible with mediation; ;<\/li>\n\n\n\n<li>the willingness to seek an amicable solution in good faith.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It is recommended to have the main useful documents available (contract, quote, invoices, correspondence, photographs, complaint letters, etc.).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>How to find a private mediator<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">You can search for a mediator:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>with the courts of appeals (lists of registered mediators); ;<\/li>\n\n\n\n<li>the conclusion of mediation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The mediator facilitates dialogue but does not provide legal advice to the parties and never makes decisions on their behalf.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Typical timeframes<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Deadlines vary depending on the complexity of the case:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Initial contact: a few days; ;<\/li>\n\n\n\n<li>First meeting: one to four weeks; ;<\/li>\n\n\n\n<li>Simple mediation: one to six weeks; ;<\/li>\n\n\n\n<li>complex mediation: two to six months.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These timeframes are generally much shorter than those involved in legal proceedings.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Possible outcomes<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Mediation can result in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>complete agreement; ;<\/li>\n\n\n\n<li>a partial agreement ;<\/li>\n\n\n\n<li>an agreement in principle requiring further verification; ;<\/li>\n\n\n\n<li>a lack of agreement; ;<\/li>\n\n\n\n<li>a suspension of mediation at the request of one of the parties.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">When an agreement is reached, it can be formalized in writing.
